Three Things Trump Can Do to Safeguard the Second Amendment (Without Congress)

Donald Trump pledged to bring a wrecking ball to the D.C. bureaucracy when he returned to the White House, and now that he’s won a second term he will soon be in a position to dismantle the gun control apparatus that Joe Biden and Kamala Harris have erected within the executive branch. 

While Republicans could also have control of both chambers of Congress, Democrats have a pretty good shot at a slim majority in the House. If that happens we won’t be able to see legislative items like national right-to-carry reciprocity enacted into law (at least for another two years), but there’s still plenty that Trump and Republicans can do to safeguard our Second Amendment rights. 

First, Trump can and should shutter the White House Office of Gun Violence Prevention, which has enshrined numerous figures from the gun control lobby within the executive branch since Joe Biden announced its creation last September. Those gun control activists can go back to work for Everytown, Moms Demand Action, Giffords, and Brady, but they shouldn’t get a paycheck from the federal government while they’re working to restrict our rights. 

Trump can also replace ATF Director Steve Dettelbach with a non-partisan professional who doesn’t view the firearms industry or gun owners as the enemy. Dettebach, remember, was Biden’s second choice for ATF director; nominated after gun control activist David Chipman couldn’t get confirmed by the Senate. While Dettelbach’s resume didn’t include stints at gun control outfits like Giffords, he was still a reliable working partner for the gun control lobby over the past few years. I doubt we’ll see the ATF disbanded completely, but the agency could be placed under the authority of the Treasury Department instead of the Department of Justice, which would be another step in de-weaponizing the agency. 

After he’s inaugurated for his second term, Trump will be able to undo Biden’s executive orders on firearms. Trump can axe the ATF rules that treat unfinished frames and receivers as completed firearms and brace-equipped pistols as short-barreled rifles, which are already being challenged in court. He can scrap the ATF’s move to expand the definition of who is “engaged in the business” of dealing firearms to include individuals who merely offer a gun for sale from their private collection; a rule that Biden put in place in order to get as close to “universal” background checks (and a backdoor gun registry) as possible. Most importantly, he can ensure that the ATF doesn’t try to write new laws under the guise of regulations in the future.

Trump will bring a new mindset to the executive branch when it comes to our Second Amendment rights. We won’t have a president calling for a ban on “assault weapons” on a weekly basis, making false claims about the Founders not being able to own cannons, or telling tall tales about deer in kevlar vests. The firearms industry and lawful gun owners won’t be scapegoated for the actions of criminals and evil individuals whose goal is to murder as many people as possible. 

Joe Biden and Kamala Harris used their bully pulpit to demand infringements on our Second Amendment rights, but Trump and J.D. Vance can use their positions to promote a culture of lawful and responsible gun ownership that’s protected and secured by the Constitution and the Bill of Rights. A new day is coming, and the anti-2A actions of the current administration will hopefully soon be swept away.
